These Terms of Services (“Terms”) govern your use of DigiLocker. DigiLocker (hereinafter may be referred to as ‘Site’) is an application designed, developed, and hosted by the National e-Governance Division under the Ministry of Electronics
and Information Technology (“MeitY”), Government of India. DigiLocker and all data, text, designs, pages, graphics, user interfaces, visual interfaces, images, artwork, photographs, trademarks, logos, audio and video, and HTML code, source
code, or software (collectively, “Content”) that reside or are viewable or otherwise discoverable on the Site are the property of National e-Governance Division, Ministry of Electronics and Information Technology.
By visiting
or using DigiLocker, you expressly agree to and consent to be bound by these Terms, as updated from time to time. You represent and warrant that you have the authority to accept this Agreement on behalf of yourself, a company, and/or
other group or entity, as applicable. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, DO NOT USE THE SITE.
This Agreement, any accompanying Terms, and any documents incorporated into this Agreement by reference constitute
the entire agreement between You and DigiLocker regarding the Site and shall supersede all prior agreements and understandings that you may have previously accepted governing your use of DigiLocker, whether written or oral, or whether
established by custom, practice, policy or precedent, with respect to the subject matter of this Agreement.
Nothing in this Agreement shall be construed to grant you a right to any other DigiLocker service and MeitY reserves
the right to discontinue any DigiLocker product or service at any time in its sole discretion.
Description of Service
DigiLocker is a digital storage and sharing platform for your personal documents and certificates. The Site allows secure access to documents issued by the government agencies and other institutions. The Site also provides you a personal
cloud space to store your documents and certificates in your account by uploading them. The key features of the Site include, but are not limited to, creation of digital lockers, storing documents and sharing of government issued
or other documents and uniform resource identifiers (URIs) with different public or private organisations. DigiLocker is accessible to all Indian citizens who can open their accounts with their mobile numbers.
Ownership of Content and Licence
When you use the Site, you provide us with your files, documents, certifications, and other information regarding these documents, as well as the eKYC details from Aadhaar in the event of Aadhaar-linked accounts. You also give us and our registered issuers
permission to store your documents or certificates in your DigiLocker electronically, or via URIs. You can share your contents with others using DigiLocker. Unless you share your documents with others, no one can access
them.
DigiLocker grants you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Services, subject to and in accordance with our Terms. This license is for the sole purpose
of enabling you to use our Services in the manner permitted by our Terms. Violation of any of the terms below will result in the termination of your account.
You retain any intellectual property rights that you
have in your content. We do not claim ownership in any of your content, including any text, data, information, and files that you upload, share, or store in your DigiLocker account. However, we need you to give us some
legal permissions (known as a ‘licence') to use this content, including to host your content on our servers and back it up. This is solely for the purposes of providing and improving our products and services. This
licence will end when your content is deleted from our Site.
You are solely responsible for contents you share and consequences thereof. DigiLocker does not actively pre-screen content, but it reserves the right
to refuse or remove any content or account that in its sole discretion is found to be unlawful, offensive, threatening, promoting violence, defamatory, pornographic, or violating DigiLocker Terms of Service and Privacy
Policy or violating any other user or party's intellectual property rights.
Account, Security and Consent
To use DigiLocker services, you are required to open an account. You are solely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential.
You must enter your mobile number when creating an account on DigiLocker. By linking your Aadhaar number to your DigiLocker account, you grant DigiLocker permission to use your Aadhaar information for authentication and to retrieve your eKYC data from the UIDAI servers in order to provide the DigiLocker service.
Government departments and organisations which are registered with DigiLocker can deposit digital copies of documents and certificates issued by them, directly into the citizens lockers or allow these documents to be accessed through uniform resource identifiers (URIs) from issuer repositories. These issuers could be public or semi-public bodies or private agencies, institutions, and corporations. By creating an account on DigiLocker, you hereby give your irrevocable consent to these issuing bodies to lodge your documents and certificates with your the DigiLocker application.
Disclaimers
DigiLocker has been designed to provide high availability, tested for functionality and audited for security by CERT-IN empanelled agency, however, DigiLocker does not promise, represent or warrant that the Site or any content, service or feature of the Site will be error-free or uninterrupted, or completely secure.
DigiLocker does not warrant that the efficiency of any product, service, information, or other material obtained by you through the Site will meet user’s or any other person’s expectations, achieve any intended result, be compatible or work with any software, system or other services except if and to the extent expressly set forth in the specifications or that any errors in the site will be corrected. The Site and its content are delivered on an "as-is" and "as-available" basis. All information provided on the Site is subject to change without notice. DigiLocker disclaims all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose.
Limitation on Liability
You expressly understand and agree, that in no event will DigiLocker, Ministry of Electronics and Information Technology or the Government of India be liable for any expense, loss or damage including, without limitation, indirect, consequential, exemplary or incidental loss or damage, or any expense, loss or damage whatsoever arising from use, or loss of use, of data, arising out of or in connection with the use of DigiLocker.
Indemnity
You agree to defend, indemnify, and hold harmless DigiLocker and its affiliates, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) relating to any allegation or third-party legal proceeding to the extent arising from:
a) your use of and access to the Site and Service.
b) your violation of any term of this Agreement.
c) your violation of any third party right, including without limitation, any copyright, property, or privacy right; or
d) any claim that your User Content caused damage to a third party.
Limitation on Use
The DigiLocker platform is for your personal use only and not for commercial exploitation. You may not decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, copy, modify, reproduce, republish, distribute, display, or create derivative works from DigiLocker. Nor may you use any network monitoring or discovery software to determine the site architecture, or extract information about usage, individual identities or users. You will not use any robot, spider, other automatic software or device, or manual process to monitor or copy DigiLocker without our prior written permission. Any unauthorized use of DigiLocker is prohibited. The use of any software (e.g., bots, scraper tools) or other automatic devices to access, monitor or copy the website pages is prohibited unless expressly authorized by DigiLocker in writing.
You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of DigiLocker or others.
Right to Modify or Terminate
DigiLocker reserves the right, at any time, to modify or discontinue, temporarily or permanently, the Service (or any part of it), with or without notice. DigiLocker in its sole discretion reserves the right to suspend or terminate any user account and refuse any current or future use of the platform for any reason at any time. Such termination may result in the deactivation or deletion of the account, and the loss of all the content hosted therein.
Translations
Translations on the DigiLocker portal are prepared by third party translators. Reasonable efforts have been made to provide an accurate translation; however, no automated translation is perfect nor is it intended to replace human translators. Translations are provided as a service to users of DigiLocker portal and are provided “as is.” Some content (such as images, videos, Flash, etc.) may not be accurately translated.
No liability is assumed by DigiLocker for any errors, omissions, or ambiguities in the translations from English into any other language provided on this portal. If any questions arise concerning the accuracy of the information presented by the translated version of the website, please refer to the English version of the website, which is the official version. If you would like to report a translation error or inaccuracy, we encourage you to please contact us.
Miscellaneous
DigiLocker reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without written notice by posting the modified Terms on this website indicating the ‘last updated date.’ Any changes we make will be effective immediately. Accordingly, you take the responsibility to check these Terms of Use periodically for changes. Your continued use of the Site posts such revision shall constitute acceptance of the modified Terms.
Jurisdiction
These Terms shall be governed by and construed in accordance with the Indian law. Any dispute arising under these Terms shall be subjected to the exclusive jurisdiction of the courts located in New Delhi only.
